Nothing is ever black and white. There is always grey area. And sense of right and wrong, good and evil, those are all relative. You do not know all the circumstances and you don't even know if what info has been given to us is true... so you really can't make a fair judgement.
Assuming that he's telling the truth, it would be nice to understand the GMs reasoning. But really, this is a trivial thing. He chose a horrible guild name with a horrible reputation behind it. He also got refunded his plat, so he's not out A SINGLE thing, IMO. In fact, I would thank the GM for giving me a chance to change my guild's name to something that didn't suck.

Regardless of if he "stole" the name or not it should be first come first serve.
If the facts are the smaller guild made the name first, regardless of intentions with the name then they should keep the name. Does it suck for the bigger guild? Absolutly. However life isnt fair and neither are games. That said the same idea applies to the smaller guild. Life isnt fair and neither are games.
Two points:
If you took Goon Squad, that's pretty blatantly copying their name. That's a fairly infamous guild name. And not generally for good reasons.
But... since when do guilds trademark their guild name? Many guild names are replicated and re-used. If they wanted the guild name on that server, they should've rolled there first and gotten it.
